PLEASE READ THIS LEGAL NOTICE CAREFULLY BEFORE USING ANY PLUMPAW PRODUCT. BY PURCHASING, RECEIVING, OR USING A PLUMPAW PRODUCT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE TERMS OF THIS LEGAL NOTICE.

1. Age Restriction

PlumPaw products are NOT suitable for infants under 12 months of age. Do not place, leave, or use a PlumPaw product in the crib, bassinet, sleep environment, or unsupervised reach of any child under 12 months old.

PlumPaw products contain plush fabric, fillings, electronic and mechanical components, including but not limited to a battery-powered motor, internal moving parts, removable components, and soft materials that may pose serious hazards to infants under 12 months, including but not limited to: suffocation, strangulation, choking, entanglement, and Sudden Infant Death Syndrome (SIDS) risk.

In accordance with safe sleep guidelines published by the American Academy of Pediatrics (AAP), the Canadian Paediatric Society, and the U.S. Consumer Product Safety Commission (CPSC), no soft objects, plush toys, pillows, blankets, or similar items should be placed in an infant's sleep area during the first 12 months of life.

By purchasing or using a PlumPaw product, you confirm that:

  • You are at least 18 years of age, or the age of majority in your jurisdiction.
  • You will not place, leave, or use a PlumPaw product in the sleep environment of any child under 12 months of age.
  • You will use the product only as a supervised comfort companion for children 12 months and older, with active and continuous adult supervision.
  • You assume full responsibility for following all safe sleep guidelines and for the safety of any child in the presence of the product.

FAILURE TO FOLLOW THIS AGE RESTRICTION MAY RESULT IN SERIOUS INJURY OR DEATH. PLUMPAW ACCEPTS NO LIABILITY FOR USE OF THE PRODUCT WITH INFANTS UNDER 12 MONTHS OF AGE.

2. Not a Medical, Therapeutic, or Safety Device

PlumPaw products are comfort and lifestyle products only. They are:

  • NOT a medical device.
  • NOT a therapeutic device.
  • NOT a sleep safety device.
  • NOT a baby monitor or supervision aid.
  • NOT intended to diagnose, treat, cure, mitigate, or prevent any medical condition, disease, disorder, or symptom, including but not limited to anxiety, sleep disorders, colic, reflux, autism, ADHD, sensory processing disorders, or any pediatric condition.
  • NOT designed to replace medical advice, supervision, monitoring devices, or professional childcare.
  • NOT evaluated, certified, approved, endorsed, or regulated by the U.S. Food and Drug Administration (FDA), Health Canada, the European Medicines Agency (EMA), or any other medical regulatory authority.

Any health, wellness, or comfort claims related to PlumPaw products are based on customer feedback and general comfort principles, not clinical studies. Individual results vary.

Always consult a qualified pediatrician or healthcare professional before introducing any new product into a child's sleep, comfort, or care routine — especially for children with existing medical conditions, developmental differences, or specific health considerations.

3. Required Adult Supervision

PlumPaw products must be used only under direct, active, and continuous adult supervision at all times. The product must never be:

  • Left unattended with a child.
  • Used as a substitute for parental, caregiver, or professional supervision.
  • Placed in a crib, bassinet, or any unsupervised sleep environment.
  • Used while the child is asleep without an adult present and awake.
  • Operated by anyone unable to safely understand and follow the product instructions.

The user assumes full responsibility for ensuring proper supervision at all times.

4. Assumption of Risk

By purchasing, receiving, or using any PlumPaw product, you knowingly and voluntarily assume all risks associated with its use, including but not limited to:

  • Risk of injury to children, infants, pets, or other persons.
  • Risk of suffocation, strangulation, choking, entanglement, or SIDS.
  • Risk of allergic reaction to materials, fabrics, or fillings.
  • Risk of electrical, mechanical, or battery-related malfunction.
  • Risk of fire, burns, or overheating.
  • Risk of property damage.
  • Risk of emotional, psychological, or behavioral effects on the user or child.

You acknowledge that no product is entirely without risk and that you are using the product at your own discretion and risk.

5. Proper Use & Inspection

You agree to:

  • Read all instructions, warnings, and labels included with the product before use.
  • Inspect the product before each use for any damage, wear, loose parts, exposed wiring, or other potential hazards.
  • Discontinue use immediately if any defect, damage, or abnormality is observed.
  • Keep the product away from water, fire, heat sources, and direct sunlight.
  • Remove the motor and electronic components before any washing or cleaning.
  • Follow all care instructions, charging instructions, and safety warnings provided.
  • Store the product safely out of reach of children when not in supervised use.
  • Replace batteries only with the type and voltage specified.

Misuse, modification, alteration, repair, or use contrary to instructions voids all warranties and releases PlumPaw from any and all liability.

6. No Warranty Beyond Limited Warranty

EXCEPT FOR THE LIMITED 60-DAY WARRANTY PROVIDED IN OUR REFUND & RETURN POLICY, PLUMPAW PROVIDES ALL PRODUCTS "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

PLUMPAW EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE

Some jurisdictions do not allow the exclusion of certain warranties; in such cases, the above exclusions apply to the maximum extent permitted by law.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PLUMPAW, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, MANUFACTURERS, DISTRIBUTORS, OR PARTNERS BE LIABLE FOR ANY:

  • DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL
  • PERSONAL INJURY, EMOTIONAL DISTRESS, OR DEATH
  • PROPERTY DAMAGE OF ANY KIND
  • DAMAGES ARISING FROM PRODUCT MISUSE, MODIFICATION, OR USE CONTRARY TO INSTRUCTIONS
  • DAMAGES ARISING FROM USE WITH ANY CHILD UNDER 12 MONTHS OF AGE
  • DAMAGES ARISING FROM LACK OF ADULT SUPERVISION
  • DAMAGES ARISING FROM ANY MEDICAL CONDITION, ALLERGIC REACTION, OR HEALTH OUTCOME

ARISING OUT OF OR RELATED TO THE PURCHASE, POSSESSION, USE, OR INABILITY TO USE ANY PLUMPAW PRODUCT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT PLUMPAW HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO A PLUMPAW PRODUCT SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental, consequential, or certain other types of damages, so the above limitations may not apply to you in their entirety. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless PlumPaw, its owners, officers, employees, agents, affiliates, suppliers, manufacturers, distributors, and partners from and against any and all claims, demands, lawsuits, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your purchase, possession, or use of any PlumPaw product.
  • Your violation of this Legal Notice or any other PlumPaw policy.
  • Your misuse, modification, or alteration of the product.
  • Use of the product with any child under 12 months of age.
  • Lack of adult supervision during product use.
  • Your violation of any applicable law, regulation, or third-party right.
  • Any claim, injury, or damage caused by you or any person using the product through you.

This indemnification obligation survives the termination of any agreement and the discontinuation of product use.

9. No Liability for Third-Party Information

Information, advice, testimonials, reviews, and content from customers, influencers, social media, or third parties regarding PlumPaw products are for general informational purposes only. PlumPaw does not endorse, verify, or take responsibility for any third-party statements or claims about its products.

10. Allergens and Materials

PlumPaw products may contain materials that could trigger allergies in sensitive individuals, including but not limited to fabrics, dyes, fillings, plastics, adhesives, or metals. If you, your child, or anyone in your household has known sensitivities or allergies, review the product materials before use. Discontinue use immediately if any allergic reaction occurs and consult a medical professional.

11. Battery and Electronic Safety

PlumPaw products contain batteries and electronic components. You agree to:

  • Never disassemble, puncture, crush, expose to fire, or short-circuit any battery.
  • Never charge with a non-approved charger or cable.
  • Never use a damaged, swollen, or leaking battery.
  • Keep batteries and electronic components away from children at all times.
  • Dispose of batteries in accordance with local regulations.

PlumPaw is not liable for damage, injury, or loss resulting from improper handling, charging, or disposal of batteries or electronic components.

12. Force Majeure

PlumPaw shall not be liable for any failure or delay in performance arising from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, civil unrest, labor disputes, government actions, internet outages, supplier failures, or shipping delays.

13. Severability

If any provision of this Legal Notice is found to be unenforceable, invalid, or illegal, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Governing Law and Jurisdiction

This Legal Notice shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law principles. Any dispute arising from or related to this Legal Notice or any PlumPaw product shall be resolved exclusively in the courts located in Quebec, Canada, and you consent to the personal jurisdiction of such courts.

Nothing in this section limits any non-waivable consumer rights you may have under the mandatory laws of your jurisdiction.

15. Entire Agreement

This Legal Notice, together with our Terms of Service, Privacy Policy, Refund & Return Policy, and Shipping Policy, constitutes the entire agreement between you and PlumPaw regarding your use of any PlumPaw product and supersedes any prior agreements, representations, or understandings.

16. Acknowledgment

BY PURCHASING, RECEIVING, OR USING A PLUMPAW PRODUCT, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS ENTIRE LEGAL NOTICE, UNDERSTAND ITS TERMS, AND AGREE TO BE BOUND BY IT. YOU FURTHER ACKNOWLEDGE THAT YOU HAVE BEEN GIVEN AMPLE OPPORTUNITY TO REVIEW THIS LEGAL NOTICE AND CONSULT WITH LEGAL OR MEDICAL PROFESSIONALS IF DESIRED.

IF YOU DO NOT AGREE WITH ANY PART OF THIS LEGAL NOTICE, DO NOT PURCHASE, USE, OR OPEN ANY PLUMPAW PRODUCT, AND RETURN IT IMMEDIATELY IN ACCORDANCE WITH OUR REFUND & RETURN POLICY.
